The Nigerian Electricity Regulatory Commission is an independent body, established by the Electric Power Sector Reform Act of 2005 to undertake technical and economic regulation of the Nigerian Electricity Supply Industry. The Commission is to, among others license operators, determine operating codes and standards, establish customer rights and obligations and set cost reflective industry tariffs. The Commission has its head quarters in Abuja, and has currently six zonal offices in the six geopolitical zones of the country.

The Commission hereby invites qualified and interested members of the public to fill the position below for the Nigerian Electricity Supply Industry (“NESI”):

Job Title: Dispute Resolution Counsellor

Location: Abuja

Details

  • Section 71(2)(c) of Electric Power Sector Reform Act (“EPSRA”) empowers the Commission to make referral of disputes to arbitration, mediation or any other means of alternative dispute resolution as part of the terms and conditions of licenses issued by NERC and the Dispute Resolution Panel (“DRP”) is the alternative dispute resolution platform for resolution of disputes between licensees and market participants. The DRP has 10 members appointed by the Commission.

Responsibilities
The responsibilities of the DRC as specified in Rule 42.3.1 of the Market Rules for Transitional and Medium-Term Stages of the Nigerian Electricity Industry (the “Market Rules” or “Rules”) are as follows:

  • Administering and ensuring effective operation of the dispute resolution provisions of the Market Rules and the Grid Code.
  • Specifying the format of notices of dispute and the responses thereto.
  • Nomination of members of the DRP.
  • Assigning members of the DRP to mediate, conciliate, arbitrate or otherwise resolve disputes in accordance with Rule 43 of the Market Rules.
  • Facilitating the resolution of disputes governed by the dispute resolution provisions of the Market Rules and the Grid Code.

  • The Market Rules can be downloaded from the Commission’s website www.nerc.gov.ng

Minimum Qualifications / Experience

The minimum qualifications and experience for the role are as follows:

  • A Bachelor’s Degree in Law, Accountancy, Economics, Finance Or Administration.
  • Experience or professional qualifications in generation, transmission, system operation,distribution or marketing of electricity.
  • Significant work experience in the Nigerian electricity industry or that of any other jurisdiction; or other comparable sectors that would demonstrate that the applicant can quickly obtain an understanding of the Nigerian electricity industry.
  • A detailed understanding of the Nigerian electricity industry with particular expertise in regulation, regulatory law and economics, licensing and other regulatory practices, project finance, commercial transaction documentation and commercial contract management.
  • A minimum of 15-years cognate experience in alternative dispute resolution resolving commercial disputes.

Term

  • The successful candidate shall be appointed as DRC for a term of 5-years (subject to a probationary period as determined by the Commission) and may be eligible for re-appointment for a final term of 5-years.
